反垄断法的执行可分为公共执行与私人执行,我国现行反垄断法的执行体系以公共执行为主,宣示性设置了私人执行。反垄断法私人执行在经济上有益,在法理上可行,通过分析我国与国外的反垄断法私人执行,建议我国反垄断法私人执行应设置双倍惩罚性赔偿制度,完善私人诉讼制度和设立反垄断私人执行干预制度。
The implementation of antitrust law can be divided into public enforcement and private enforcement. The enforcement system of the current antitrust law in our country mainly focuses on public enforcement, and declares the establishment of private enforcement. The private enforcement of antitrust law is economically beneficial and legally feasible. By analyzing the private enforcement of antitrust law in our country and abroad, it is suggested that the private enforcement of antitrust law in our country should set up double punitive damages system, improve the private litigation system and establish anti-monopoly law Monopoly of private enforcement intervention system.
