在我国,森林病虫害防治法律制度实施存在着立法不完善、执法困难、监督不到位,利益关系复杂,利益化倾向较严重,社会背景和历史根源的羁绊,法律素质不高和自然条件的影响等问题,因此,必须实施保障森林病虫害防治法律制度有效对策,完善立法,改进执法,加强监督,协调各种利益关系,提高公民的法律意识和法律素质,为制度实施提供良好的社会环境。
