《刑事诉讼法修正案(草案)》把公安机关定性为司法机关的规定不仅与国际通例相左,而且不符合我国《宪法》规定的中国特色政治体制与司法体制的内涵。根据我国《宪法》、相关法律以及中央有关重要文件,刑事诉讼中的人民法院、人民检察院是司法机关而公安机关是行政机关。公安机关在刑事诉讼中所进行的侦查活动属于司法活动,但不能因此把负责侦查任务的公安机关及其他专门机关升格为司法机关。在中国现实的政治体制之下,不宜在此次《刑事诉讼法》修改中贸然将公安机关确认为司法机关。
The “Provisions of the Criminal Procedure Law Amendment (Draft)” defining the public security organs as judicial organs not only contravene the international norms, but also do not conform to the connotation of the political system and judicial system with Chinese characteristics stipulated in the “Constitution” of our country. According to the “Constitution” of our country, relevant laws and relevant important documents from the Central Government, people’s courts, people’s procuratorates in criminal proceedings are the judiciary and public security organs are administrative organs. The investigation activities carried out by the public security organs in criminal proceedings belong to judicial activities, but public security organs and other specialized agencies responsible for the investigation can not be upgraded to judicial organs. Under the reality of China’s political system, it is not appropriate to confirm the public security organ as the judicial organ in the revision of the Criminal Procedure Law.
