目前,在基层法院的审判工作中,以法律作为唯一判案标准的意识面临着一定的挑战。文章列举了某些法官由于从思想上对法律至上意识的淡漠,造成随意违反法定程序、胡乱引用法律条文、排斥新颁布的法律规定、为个案正义而变通法律等情况。通过分析导致上述现象的原因,提出相应的措施,以求提高法官们法律至上的意识,解决基层法官不严格适用法律的问题。
At present, the awareness of using the law as the only criterion in the trial of grass-roots courts faces some challenges. Article lists some judges due to ideological indifference to the supremacy of law, resulting in arbitrary violation of legal procedures, indiscriminate reference to legal provisions, the exclusion of newly enacted legal provisions, case law and other flexible work. By analyzing the causes of the above-mentioned phenomena, we put forward corresponding measures in order to raise the awareness of the judges in the supremacy of the law and to solve the problem that grassroots judges do not strictly apply the law.
