文章以商事案件的执行为典型,分析探讨执行难的成因及对策。执行难是困扰法院工作的一个难题,长期存在,得不到根本解决。造成执行难的原因很多,也很复杂,是我们国家经济、社会转型、过渡时期产生的法律现象。解决执行难问题是一项复杂的系统工程,需要从改革执行体制、完善执行措施、构建执行监督机制等方面多管齐下,加以解决。
The article takes the execution of commercial cases as a typical example, analyzes and discusses the causes and countermeasures of implementation difficulty. Difficulties in implementation are problems that plague the work of the courts. They persist for a long time and can not be fundamentally solved. There are many and complicated reasons for the difficulty of implementation. They are the legal phenomena that have taken place in our country’s economy, social transformation and transition period. Solving the difficult issue of implementation is a complex systematic project that needs to be solved in a multi-pronged approach from the aspects of reforming the implementation system, perfecting the implementation measures and establishing the mechanism for implementing supervision.
