国际商事仲裁程序自治与仲裁地程序法对仲裁的控制之间存在张力。但无论从国际立法规定,还是从各国国内立法的主流趋势来看,仲裁程序自治都已成为仲裁的普世价值。但目前来看,中国仲裁立法仍为例外,其规定为仲裁程序自治所留空间较为逼仄,应予彻底变革。除当事人直接约定外,仲裁庭与仲裁规则的适用,对仲裁程序自治的实现,也有重要作用。当然,仲裁程序自治一般不可突破仲裁地仲裁程序法强制性规则的底线,否则将无法获得有效裁决。
International Commercial Arbitration Procedures There is tension between the procedural laws governing arbitration and arbitral proceedings. However, judging from the international legislation and the mainstream trend of national legislation in various countries, the autonomy of arbitral proceedings has become the universal value of arbitration. However, at present, the arbitration legislation in China is still an exception, which stipulates that the space for self-government of arbitration proceedings should be relatively tight and should be completely changed. Except for the direct agreement of the parties, the application of the arbitration tribunal and the arbitration rules also play an important role in the autonomy of the arbitration proceedings. Of course, the autonomy of arbitral proceedings can not generally break the bottom line of the mandatory rules of the Arbitration Procedure Law, otherwise no valid verdict will be obtained.
