西方学者在论及保护责任中武力使用的合法性时多以正义战争理论作为其法理基础。不论是西方古典正义战争论还是自然法正义战争论,其本身都存在固有的缺陷,且它们所产生与发展的时代与今天国际政治环境相去甚远,难以为保护责任中武力使用提供充分合法性支持。倒是马克思主义正义战争观——注重对战争的政治考察,坚持社会进步标准——有助于我们认清保护责任中武力使用的本质。
When discussing the legitimacy of the use of force in the responsibility to protect, western scholars mostly take the theory of just war as the basis of their jurisprudence. Both the theory of the western classical justice and the theory of the justice of natural law have inherent flaws, and their era of development and development is far from the current international political environment.
