中国《海商法》下多因致货损承运人责任研究涉及中国《海商法》下首要义务的认定问题,举证责任的冲突及不合理问题,其中举证责任的讨论中涉及火灾责任举证和迟延交付的举证。多因致损下承运人责任判断牵涉到中国《海商法》下相关法条的解释和应用,然而中国《海商法》下各法条的应用和解释有时会出现冲突和相悖,由此本文从国际海运的特殊性和国际公约的发展沿革着手,通过分析中国《海商法》在制定时所借鉴的相关国际公约,如《海牙规则》《汉堡规则》,结合新形式下的具有代表性的《鹿特丹规则》的规定提出我国《海商法》可以修改的部分,并提出拙见。
