国防动员立法的外部性分析,实质就是国防动员法律制度的效益分析。效益分析不仅仅是经济学特有的价值和方法,它也是法学的根本价值和方法所在。但国防动员法律制度的价值不仅限于效益,它还包括安全、公平、正义、人权等。因此,国防动员立法外部性的分析更加强调由社会、政治、经济等决定的价值和意识形态对国防动员法律制度的影响。
The external analysis of national defense mobilization legislation is essentially a benefit analysis of the legal system of national defense mobilization. Benefit analysis is not only the unique values and methods of economics, but also the fundamental values and methods of jurisprudence. However, the value of the legal system for national defense mobilization is not limited to benefits. It also includes security, fairness, justice and human rights. Therefore, the analysis of the legislative externality of national defense mobilization further emphasizes the impact of the values and ideologies determined by society, politics and economy on the legal system of national defense mobilization.
