物权变动制度是物权制度中非常复杂且引起争议较大的一项制度,关系众多人之利益,而登记作为不动产物权变动的公示要件,已经在各国的立法中得到认可,因此对登记在物权变动制度中的作用的探讨应该是非常重要的。本文通过中日两国现行法对登记制度采取的不同模式和规定的考察,认为不动产物权变动模式是不同国情下的产物,登记是权利人保全物权的一种手段,但立法对登记赋予不同的效力,在制度的建设方面会有很大的不同,正是这些配套的制度使得不同的效力下,立法侧重保护的利益会有很大的不同。而日本与我国截然不同的变动模式也将给我我国物权立法带来很大的借鉴。
