2000年12月1日,《中华人民共和国种子法》颁布实施。根据《种子法》规定,主要林木的商品种子生产和林木经营实行许可制度。主要林木良种的林木种子生产、经营许可证,由生产、经营者所在地县级人民政府林业行政主管部门审核,上报省、自治区、直辖市人民政府林业行政主管部门核发;其他林木种子生产、经营许可证,由生产、经营者所在地县级以上地方人民政府林业行政主管部门核发。实行选育、生产、经营相结合,注册资本金2000万元以上的种子公司和从事林木种苗进出口业务公司的《林木种子经营许可证》由注册
