法治思维,作为一种治理国家和社会的思维模式,其逻辑起点是治理活动(包括公权力的运行和广大民众的守法),它具有治理、合法、公平正义与责任等特征。我国当代的法治思维,应立足在中国特色社会主义制度这一基点上进行,受社会主义法治理念指引,并应遵循党的思想路线这一基本准则。只有这样,法治思维才有可能不偏离方向,才能得出正确的思维结果,才能更好地为实现国家治理和社会建设的目标服务。 As a thinking mode of governing the country and society, the logic starting point of the rule of law is its governance starting point (including the operation of public power and the law-abiding of the general public). It has the characteristics of governance, lawfulness, fairness, justice and responsibility. The contemporary thinking of the rule of law in our country should be based on the basic point of the socialist system with Chinese characteristics and guided by the socialist concept of the rule of law and should follow the basic principle of the party’s ideological line. Only in this way will it be possible for the rule of law thinking not to deviate from the direction and to draw the correct thinking results so as to better serve the goal of realizing state administration and social construction.
