问:我的一位亲戚在下夜班途中,被派出所民警以调查案件为由带到派出所,让他交代盗窃某某家的经过。但我亲戚确实没做过这种违法的事,叫他何从说起。于是他们就对他讯问了整整一个晚上,直到第二天中午,才让他的家人给带回家。因为这件事,在当地引起了风言风语,使我亲戚的名誉受到了很大的损害。出了这种事,我们该怎么办?答:对于这种事,你们可以依据《国家赔偿法》向该部门要求国家赔偿。该法第二条规定:国家机关和国家机关工作人员违法行使职权侵犯公民、法人和其他组织的合法权益造成损害的,受害人有依照本法取得国家赔偿的权利。国家赔偿由本法规定的赔偿义务机关履行赔偿义务。
