《职业教育法》的修订必须在调整对象、立法目的和价值理念等方面与《教育法》《高等教育法》相衔接、相协调,以避免法律规定的冲突或重复。职业教育法作为教育法的二级部门法,应以职业教育领域的特殊性社会关系为自己的调整对象,立法目的主要在于确定职业教育的基本法律地位以及为实践性教学环节的有效实施提供切实可行的制度保障。《职业教育法》作为行政法的分支,与一般的部门行政法的不同之处在于教育机构(学校)作为行政相对人享有办学自主权。为切实维护教育机构(学校)的办学自主权,在立法模式上,职业教育法宜采取否定性的立法路径。
The revision of the Vocational Education Law must be linked with and coordinate with the Higher Education Act of Education Law in terms of the object of adjustment, the purpose of legislation and the concept of value, so as to avoid the conflict or duplication of laws. As a secondary department law of education law, the law of vocational education should be the object of its own adjustment in the field of vocational education. As a branch of administrative law, the Vocational Education Law differs from the general departmental administrative law in that education institutions (schools) enjoy the autonomy of running a school as an administrative counterpart. In order to effectively protect the educational autonomy of schools (schools), in the legislative model, Vocational Education Law should adopt a negative legislative path.
