商业保释制度在世界范围内备受争议,它节省了国家的司法资源,让更多的被追诉人获得审前的自由,也促进了司法机构的正常运转。但是,商业保释将国家的权力让渡给私人,可能危及被追诉人甚至第三人的权益,妨碍司法活动正常进行。除美国的大多数州和菲律宾之外的普通法国家和地区均抵制商业保释制度,他们采用具结、刑事处罚、非经济性的行为控制、非商业性的保释保证金等方式替代商业保释。在我国羁押率偏高的形势下,有必要借鉴商业保释制度,吸收社会力量参与非羁押性强制措施的适用,建立我国的审前释放保障体系。
The commercial bail system has been disputed around the world. It saves the country’s judicial resources, gives more prosecutors freedom of trial and promotes the normal functioning of the judiciary. However, the release of commercial bail to private individuals through the power of the State may jeopardize the rights and interests of the accused and even a third party, hampering the normal conduct of judicial activities. Commercial bail is being boycotted by most states in the United States and common law countries and regions other than the Philippines. They replace commercial bail with knotty, criminal penalties, non-financial behavioral controls and non-commercial bail bonds. Under the situation of high detention rate in our country, it is necessary to draw lessons from the commercial bail system, absorb social forces to participate in the application of non-custody coercive measures and establish the pretrial release guarantee system in our country.
