由于我国现行的《刑法》和相关的立法、司法解释对村党支部书记职务犯罪主体的界定没有明确,影响了对村党支部书记职务犯罪的统一正确惩处。本文指出在没有明确规定的情况下,将村党支部的工作人员与村民委会的工作人员一样视为“村基层组织人员”比较符合我国的国情和刑事立法精神。
Due to the current “Criminal Law” and related legislation and judicial interpretation in our country, the definition of the main body of the post crime of village party branch secretary is not clear and affects the unification and correct punishment of the party branch secretary. This paper points out that in the absence of a clear stipulation, it is better to regard the village party branch staff as the same as the staff of the village committee as “village grassroots organizations ” more in line with China’s national conditions and criminal legislation.
