公务员内部行为规范是指由行政主体制定并实施的、仅对该行政主体所属公务员及其下级机关所属公务员发生效力,通过道德性约束和规定性约束规范公务员公务行为和非公务行为的规范性文件。作为晚近逐渐兴起的行政自制理论的实践机制之一,公务员内部行为规范能够通过树立公务员的行为准则和工作原则将其行为规范于一个理想的框架内,从而促进行政权的良性运转。通过对24部已经公布实施的内部规范所进行的调查表明,对规范事项、奖惩措施和追责程序等方面加以细化和完善,是增强该种规范控权能力的主要途径。
Civil code of conduct is defined by the internal code of conduct and implementation of the main administrative body, only the civil servants belonging to the administrative body and its subordinate organs of civil servants have effect, through the moral constraints and regulatory constraints norms of civil servants and non-official acts of normative documents . As one of the practical mechanisms for the recent self-management theory, civil servants ’internal code of conduct can standardize their behavior in an ideal framework through the establishment of civil servants’ code of conduct and working principles so as to promote the healthy operation of the executive power. Through the investigation of the 24 internal norms that have been promulgated and implemented, it is shown that the refinement and improvement of normative matters, rewards and punishments, and the procedures for blame and demarcation are the main ways to enhance the normative power of such norms.
