随着知识产权在国际经济交往中地位的日益提高以及中国经济的崛起,中国迫切需要对知识产权进行法律保护,尤其是重视法律的实施效果。知识产权在全球范围内面临巨大的挑战,特别是来自互联网的挑战。在互联网法律实施过程中,著作权方面会出现哪些规制问题,哪些监管矛盾亟待解决,是网络世界面临的巨大新挑战。论文针对服务提供者的责任限制、对侵权IP地址的相关用户信息的告知义务,以及国家采取的网络准入禁止等问题进行讨论,并探讨各国合作的可行途径。面临互联网的新挑战,特别是在Web2.0网络环境下,著作权保护通过各种以自我规制为基础、以技术性方法为表现形式的规制手段得以加强。
With the increasing status of intellectual property in international economic exchanges and the rise of China's economy, China urgently needs legal protection of intellectual property rights, with particular emphasis on the implementation of laws. Intellectual property is facing enormous challenges on a global scale, especially from the Internet. In the process of Internet law enforcement, what regulatory issues will appear in copyright and which regulatory contradictions need to be resolved urgently are the enormous new challenges confronting the online world. The dissertation discusses the liability limitation of service providers, the duty to disclose the related user information of infringing IP addresses, and the prohibition of network access by the state. The paper also explores the feasible ways of cooperation between countries. Faced with the new challenges of the Internet, especially in the Web2.0 network environment, copyright protection is strengthened through various regulatory measures based on self-regulation and technical methods.
