条约监督机制作为保障国际条约得到缔约国有效履行的重要手段,已经在人权、防止核武器扩散以及军控等领域普遍采用,成为现代国际法的重要组成部分。但条约监督毕竟是国际法领域晚近发展起来的法律制度,该制度本身尚处发展阶段,仍然面临很多制度性问题和现实性问题。而这一制度与传统国际法理论的契合与衔接更是值得思考,并且应当成为条约监督制度发展的理论出发点和立足点。
As an important means to guarantee the effective implementation of international treaties, the treaty monitoring mechanism has been widely adopted in the fields of human rights, the prevention of the proliferation of nuclear weapons and arms control. It has become an important part of modern international law. However, treaty monitoring is, after all, a recently developed legal system in the field of international law. The system itself is still in its development stage and still faces many institutional and practical problems. And this system and the traditional international law of the law of convergence and convergence is worth considering, and should become the development of the treaty supervision system theory starting point and standpoint.
