跨境电子商务近年来呈现爆炸式发展,越来越多的消费者选择以此为平台进行购物,在这个过程中消费者面临着退货“无门”、信息不对称、跨境电商平台“低门槛”的性质下中小企业资质参差不齐和投诉难度大等问题。我国关于电子商务消费者权益保护的法律规范零散的分布在《民法通则》、《合同法》、《电子签名法》、《消费者权益保护法》、《产品质量法》、《食品安全法》、《反不正当竞争法》等法律以及一些行政法规和规章之中,并没有针对跨境电商背景下消费者权益保护的专门法规。针对此种情形,可以考虑借鉴欧盟和美国的做法,填补立法空白,加强国际合作,通过跨境电商企业信息公示、披露制度和在线纠纷解决机制的构建来更好的保护消费者权益。
In recent years, cross-border e-commerce has exploded, and more and more consumers choose to use it as a platform for shopping. In this process, consumers are facing the problem of “no door”, information asymmetry, cross-border electricity supplier Platform “low threshold ” in the nature of SME qualification and complaint difficult and other issues. The laws and regulations on the protection of the rights and interests of e-commerce consumers in our country are scattered in the General Rules of Civil Law, Contract Law, Electronic Signature Law, Consumer Protection Law, Product Quality Law, Food Safety Law, , “Anti-Unfair Competition Law” and other laws as well as some administrative regulations and rules, there is no specific regulation on the protection of consumers’ rights and interests in the context of cross-border e-commerce. In view of this situation, we can consider drawing lessons from the EU and the United States to fill the legislative gaps and strengthen international cooperation so as to better protect the interests of consumers through the establishment of an information disclosure and disclosure system for cross-border e-commerce enterprises and the establishment of an online dispute resolution mechanism.
