在许多国家刑事程序中,都确认了刑事非法证据排除规则.这一规则关系到实体真实与程序正义,控制犯罪与保障人权的价值取向,国家权力与公民权利冲突权衡以及刑事诉讼目的的实现,是人类对于刑事诉讼规律及违法取证危害性的认识日趋深刻的必然要求.本文在介绍国外非法证据的排除规则适用情况及我国目前非法证据排除规则的适用状况的基础上,从该规则的立法模式及相关问题的完善方面进行阐述.
