案由:1999年9月17日,姜某因其夫张某非因工死亡待遇与某鞋厂发生争议到劳动争议仲裁委员会申诉。经调查发现,张某于1993年1月16日与某鞋厂签订了期限5年的劳动合同。在此期间,张某于1996年8月9日与被诉人签订了期限1年的停薪留职协议,1997年8月9日停薪留职协议期满,被诉人既未要求张某回鞋厂上班,又未要求张某回鞋厂办理相关手续。1998年1月16日,劳动合同期限届满,劳动合同终止。某鞋厂既未与张某就续订劳动合同进行协商,也未给张某出具终止劳动合同证明。1998年1月17日后,张某也未到某鞋厂上班。直到1999年6月4日,张某因病去世。
