不动产预告登记制度是将债权物权化,为保全一种目的在于移转、变更和废止不动产物权之请求权的登记制度。在不动产交易中,因当事人双方就债权契约的成立与物权行为的履行间尚有一定时间差异,故常有债务人将不动产另作处理,如一物二卖,并将产权移转登记于后债权人的情形。此种状况,对原债权人甚为不利。鉴于此,法律上设有预告登记制度,对原债权人以不动产物权变动为标的之债权请求予以保全。
