在创建宽严相济刑事政策与和谐社会的双重背景之下,刑事司法实践跟刑法理论都趋重于宽松的刑罚。加之目前社会经济的不断发展,人民生活水平得到了显著的提高,我国社会老龄化的趋向已经十分明显,老龄化社会的到来给我国社会造成了新的问题,带来了新的矛盾,我国老年人犯罪不断发生,社会、国家、法律对老年人犯罪应重新得到考虑,在这种背景下,基于宽严相济刑事政策,老年人犯罪放宽处罚机制慢慢进入人们的关注范围之内。因此,本文针对我国现状,提出了完善老年人犯罪从宽处罚制度的建议。

Therefore, according to the status quo in our country, this article puts forward suggestions to improve the system of leniency penalty for seniors.
