一、共同体的概念在目前的法律中,理性(ratio)似乎是处于从属地位,这种状况应该加以改变。这样的需求也使人们重新思考,在维持现有的以国家中心主义为特征的法律时,也可以重新考虑以“共同体为基础”(community basis)建构的法律规制模式。
I. THE CONCEPT OF COMMUNITY In current law, rationality seems to be subordinate and this situation should be changed. Such needs also make people rethink and reconsider the legal regulatory model built on a “community basis” while maintaining existing state-centric laws.
