农村宅基地使用权是指农村集体经济组织成员(村民)在依法取得的集体组织所有的宅基地上建造自有房屋及其附属设施,并对宅基地享有的占有、使用和有限制处分的权利。宅基地是农村集体经济组织分配给村民的一种福利,它与村民的身份紧密相关,是村民生活的重要保障。目前,我国法律严格限制宅基地使用权的流转,只在少数地方开展宅基地抵押贷款的改革试点。
The right to use rural house sites refers to the right of rural collective economic organizations members (villagers) to build their own houses and their ancillary facilities on the homesteads owned by the collectively-owned collectives that are legally acquired, and have the right to the possession, use and restriction of homestead sites .
