我国滩涂资源的法律属性一直存在着海域与土地的争执,这种争执源于立法上未能对海岸线的划分标准进行明确的规定。滩涂的生态特征、域外的制度经验及我国的相关规定均表明以平均大潮高潮时水陆分界的痕迹线作为海岸线的划分标准是合适的。以此为标准,滩涂属于海域的一部分,有关滩涂的使用应适用《海域使用管理法》的规定。同时,为消除使用滩涂从事养殖活动中的重复许可,还应当通过修改《渔业法》将使用滩涂从事养殖的活动从《渔业法》的调整对象中分离出来,统一纳入《海域使用管理法》的调整范围。
