我国加入WTO后,我国的经济正融入世界经济全球化进程,而经济全球化为各国提供了大量吸引外资和创造就业的机会,也使原本较为单一的劳动关系呈现多元化、复杂化的局面。而我国《劳动法》的内容与国际劳工组织的基本劳工公约规定的内容有较大差距,笔者试就集体谈判权与集体合同、罢工权、平等就业权这三个问题对照国际劳工公约进行分析,提出完善我国劳动立法的建议,以适应WTO的要求,促进社会公平与经济发展。
After China’s accession to the WTO, China’s economy is integrating into the process of world economic globalization. Economic globalization has provided ample opportunities for all countries to attract foreign investment and create employment, and has also rendered the original relatively single labor relations a pluralistic and complex situation. However, there is a big gap between the contents of the “Labor Law” in our country and that stipulated in the ILO’s basic labor conventions. The author tries to analyze the international labor conventions on the three issues of collective bargaining and collective contracts, the right to strike and the right to equal employment , Put forward suggestions on improving our labor legislation in order to meet the requirements of WTO and promote social fairness and economic development.
