本文首先通过分析我国仲裁制度中仲裁申请撤回的相关规定,参照民事诉讼撤诉制度研究仲裁申请的撤回,并通过比较法分析了各国关于仲裁申请撤回的情形和处理方法。随后,本文着重对部分裁决和临时裁决作出后对仲裁申请撤回的处理,以及仲裁协议失效与仲裁申请撤回后再次提出的处理进行了初步的分析。
This article first analyzes the withdrawal of arbitration application by referring to the relevant provisions of arbitration application in our country’s arbitration system and the withdrawal of arbitration application with reference to the system of withdrawal of civil action and analyzes the cases and handling methods of withdrawal of arbitration application in different countries through comparative law. After that, this article mainly analyzes the handling of withdrawal of arbitration application after partial ruling and interim ruling, as well as the initial resumption of arbitration agreement and withdrawal of arbitration application.
