我国加入世贸组织后,比照世贸组织的基本原则,公安机关的法制建设需进一步加快步伐。就目前公安法制建设而言,存在以下三大问题:1.现行公安法律法规政策存在缺陷,与现代法治原则相冲突。2.行政执法管理模式陈旧,不适应市场经济的发展。3.执法理念上存在偏差,导致一些执法顽症久治不愈。要切实解决立法、执法和执法机制中存在的这些问题,首先是要转变观念,树立现代意义上的执法理念。其次要加强立法工作,逐步完善公安法制体系。第三要从适应社会主义市场经济的发展出发,改革现行的公安行政管理体制。第四要加强执法监督,建立起良性的执法与制约相辅相成的体系。
After China’s accession to the WTO, according to the basic principles of the WTO, the public security organs need to further accelerate the pace of legal construction. As far as the construction of public security legal system is concerned, there are the following three major problems: 1. The current public security laws, regulations and policies are flawed and conflict with the principle of modern legal principles. 2. Administrative management of law enforcement obsolete, not suited to the development of market economy. 3. There is deviation in the concept of law enforcement, resulting in some law enforcement stubborn persistent treatment. To effectively solve these problems existing in the legislative, law enforcement and law enforcement mechanisms, we must first change our concepts and establish the concept of law enforcement in the modern sense. Second, we should step up legislative work and gradually improve the public security legal system. The third must proceed from adapting to the development of the socialist market economy and reform the current public security administration system. Fourth, we must step up law enforcement supervision and establish a sound system of law enforcement and restriction that is mutually reinforcing.
