社区矫正制度作为一种新的刑罚执行制度,其由产生、发展到在我国的试行、适用经历了一个漫长、曲折的过程。本文在揭示社区矫正的发展历史及内涵的基础上,论述了我国社区矫正制度的历史与现状。目前,我国大陆地区的社区矫正制度还处在初创和探索阶段。为适应行刑社会化的要求,应当通过立法来对内地的社区矫正制度在具体设置、适用对象、实施机构等方面进行完善。
As a new penalty execution system, the community correction system has undergone a long and tortuous process from its birth to development in our country. On the basis of revealing the history and connotation of community correction, this article discusses the history and current situation of community correction system in our country. At present, the community correction system in mainland China is still in its infancy and exploration stage. In order to meet the requirements of the socialization of execution, legislation should be adopted to improve the system of community correction in the Mainland in terms of specific settings, applicable objects and implementing agencies.
