本文从我国对北冰洋公海渔业资源管理国际合作问题的研究背景、研究现状等方面综述了近年来国内外学术界对该问题的探讨,认为现有研究缺乏对北冰洋公海渔业资源管理的国际合作制度的全景研究,没有将一般法学理论和环境法原则作为渔业管理制度的指导原则,对国际合作的具体内容探讨较少,尤其是缺乏对北极原住民利益的考虑。未来可能会更加注重北冰洋公海渔业管理的国际合作制度的建构。
This article summarizes the domestic and foreign academic circles discussing the issue from the research background and research status quo of the international cooperation on the fishery resources management of the Arctic Ocean on the high seas. The existing research lacks the international cooperation system on the fishery resources management of the Arctic Ocean on the high seas. Panoramic research did not regard the general jurisprudence and environmental law as the guiding principle of the fishery management system and did not discuss the specific contents of international cooperation. In particular, it lacks the consideration of the interests of Arctic indigenous people. In the future, more attention may be paid to the construction of an international cooperation system for the management of the Arctic ocean high seas.
