法律人是社会结构的建造师,那么他们应当受到一种贴近于其职业的教育训练。有两种具体的方法可使法学院课程设计得更符合上述目标。首先,法律教育应当向学生提供一种理解能力,理解法律人事实上参与其中的事件过程;其次,应当倾向于提高学生对各种各样的纠纷情况进行考察和解决的能力,包括法律因素与非法律因素。案例教学法下法律教育只是关注一个方面,即司法过程,而我们应当倡导一种围绕问题场景所设计的教学,或问题教学法。
Legal people are architects of social structures, and they should be given an education that is close to their profession. There are two specific ways that law school curricula can be designed to better meet these goals. First of all, legal education should provide students with an ability to understand and understand the fact that legal people are actually involved in the process of the incident.
