本文以行政执法的内涵和其基本特征为参照,总结了计划生育行政执法中存在的一些突出的问题,以依法行政观念比较淡薄;违反程序执法时有发生;“自费执法”现象仍然存在,职权异化;执法队伍人员素质有待提高。从加强宣传、增强全社会的法律意识,切实强化计生行政执法人员依法行政的意识,健全和完善计生行政执法的监督机制,提高计生行政执法人员的业务素质等方面提出了解决这些问题建议。
Based on the connotation of administrative law enforcement and its basic characteristics, this article summarizes some outstanding problems existing in the administrative law enforcement of family planning. The concept of administration according to law is relatively weak. Violations of procedural law enforcement sometimes occur. The phenomenon of “self-financing law enforcement” still exists , Alienation of authority; law enforcement team personnel quality needs to be improved. Proposals to solve these problems are put forward from strengthening publicity, enhancing the legal awareness of the whole society, strengthening the awareness of family planning administrative law enforcement officers according to law, improving and perfecting the supervision mechanism of family planning administrative law enforcement, and improving the professional qualifications of family planning administrative law enforcement officers.
