随着国际经济交往程度的日益加深,国际货物买卖的数量也在急剧增加。《联合国国际货物销售合同公约》(以下简称《公约》)的订立,就是针对越来越多的跨国贸易,为其提供处理国际货物买卖关系的法律准绳。《公约》第35条就是具体规定了作为合同的卖方应如何满足交付货物的要求。《公约》第35条共有三款内容,第一款规定了货物与合同的相符,是判断货物合乎要求的最初条款;第二款是在当双方当事人没有达成同意的情况下适用,明确了一系列设想问题的解决;第三款则规定了卖方的对存在交付不符的免责。
With the deepening of international economic exchanges, the number of international trade in goods is also rapidly increasing. The “United Nations Convention on Contracts for the International Sale of Goods” (hereinafter referred to as the “Convention”) is aimed at increasing cross-border trade and providing them with the legal yardstick for dealing with the international sale and purchase of goods.
