形象权是自然人对由自身的一个或多个具有人格利益要素的可识别标性识的综合构成所享有利益的权利,对其权利客体的商业化利用可以带来直接的商业利益。通过对自然人形象权的保护进而对自然人人格尊严进行保护的同时,会影响到自然人对其形象的商业利用所产生的财产性利益。从形象权的性质而言,它应该是一种具体人格权而非财产权。对形象权的保护,从根本上讲是对自然人人格尊严的保护而非对财产权的保护。
