针对目前我国法律排除刑事案件精神损害赔偿制度的现状,从经济因素、司法技术、传统思想三个方面进行分析、研究,探究产生此种现状的原因,以期推动精神损害赔偿制度早日在我国发展和完善。在经济因素方面,通过实际案例揭示我国生产力落后、社会经济基础薄弱制约赔偿判决的落实;在司法技术方面,以美国为例,论证精神损害司法鉴定的复杂及我国司法技术条件落后的不利影响;在传统法律文化思想方面,从传统集团本位法律思想和公法文化两个角度阐述传统思想对刑事领域精神损害赔偿建立的影响。
In view of the present situation of the system of the mental damage compensation in criminal cases in our country, this article analyzes the reasons of economic status, judicial technology and traditional thinking, and studies and explores the reasons for such situation, in order to promote the system of mental damage compensation as soon as possible in our country. perfect.
