当前中医药事业迎来振兴的重要机遇,全面提升中医药治理体系和治理能力现代化水平成为全面深化改革与全面依法治国的重要组成部分。在这样的社会背景下,中医药治理中的法律问题不得不予以认真对待,其中虚假中医药广告治理是长期突出难题,实现虚假中医药广告行为的法律治理值得专门探究。为此,应当首先明确虚假中医药广告行为的构成要件,对该行为进行类型化分析,并从法治体系的角度寻找虚假中医药广告综合治理的制度。
At present, the cause of rejuvenation of traditional Chinese medicine ushers in an important opportunity for rejuvenation. To comprehensively upgrade the governance system of Chinese medicine and the modernization of governance capacity has become an important part of deepening the reform and comprehensively administering the country according to law. Under such a social background, the legal problems in the treatment of traditional Chinese medicine have to be taken seriously. Among them, the treatment of false Chinese medicine advertisements has long been a prominent problem and the legal administration of false Chinese medicine advertising deserves special investigation. To this end, we should first clarify the constitutional elements of false Chinese medicine advertising behavior, conduct a type analysis of the behavior, and look for the system of comprehensive management of false Chinese medicine advertisement from the perspective of the rule of law system.
