“Lex Sportiva”是随着全球体育法治发展而出现的法律秩序。“Lex Sportiva”作为一种新兴的法律秩序开始受到广泛关注,而适用传统的以国家为中心的法律理论对其进行研究存在一定的局限性。法社会学、法人类学理论的发展,为“Lex Sportiva”的研究提供了新的视野。从法人类学和法社会学视角对“Lex Sportiva”的法律属性进行分析,并根据国际体育管理的纵向化和法律自创生理论对“Lex Sportiva”作为一种新型法律的合法性进行探讨。
“Lex Sportiva ” is the legal order that comes with the development of the global sports law. As a new legal order, “Lex Sportiva” began to receive widespread attention, and its application to the traditional state-centered legal theory has some limitations. The development of legal sociology and legal anthropology provides a new perspective for the study of “Lex Sportiva”. From the perspective of legal anthropology and sociology of law, we analyze the legal attributes of “Lex Sportiva” and consider the legal system of “Lex Sportiva” as a new type of law according to the verticalization of international sports administration and law Sex to explore.
