在行政机关实施执法责任制,从实践来看,有四种关系必须处理好。一、内部自律与外部监督的关系执法责任制是一种执法机关自我约束和权力机关外部监督相结合的执法保障机制。这里的内是指执法机关的自我约束机制,外是指权力机关外部监督的机制。我们欣喜地看到,几年来,行政执法机关通过建立执法责任制,使执法人员的思想观念和工作作风发生明显的变化,依法行政和公正执法的水平不断提高。但在建立和落实执法责任制过程中,有的人只看到内部的制约机制的作用,没看到外部权力机关监督机制的作用,甚至认为,有了内部的制约机制就行了,何须权力机关的监督呢?行政执法责任制是地方人大常委会在加强法律、法规实施情况的检查监督中总结出来的一种新的监督形式,实践证明是好形式。我们应该看到任何一种内部的制约机制都有其局限性,仅能起到自律的作用,而不能起到他律的作用,没有
