半个多世纪以来,贸易与环境法律问题日益成为WTO体制下的一个热点难点问题。该问题于2001年纳入WTO多哈发展回合的谈判日程。本文通过回顾贸易与环境法律问题在多哈发展回合的确立背景,阐述该问题在多哈发展回合的谈判内容,进而评析其在多哈发展回合的历程并预测其在WTO的前景。正确认识贸易与环境法律问题在WTO的未来走向,将有助于协调二者矛盾相关措施的合理化制定。
For more than half a century, the legal issues of trade and environment have increasingly become a hot and difficult issue under the WTO system. This issue was incorporated into the 2001 WTO Doha Development Round negotiations agenda. By reviewing the background of the establishment of the round of trade and environmental law in Doha, this article elaborates the content of the round of negotiations on the issue in Doha and then evaluates its course of development in Doha and forecasts its prospects in the WTO. A correct understanding of the future direction of the trade and environmental law issues in the WTO will help coordinate the rational formulation of the contradictions between the two.
