网络技术发展的日新月异带来了法律层面规制网络环境的革命,网络服务提供商可能发生直接侵权和间接侵权行为损害权利人的利益,合理规定网络服务提供商的法律责任与责任限制制度对平衡各方利益具有重要作用。本文将对网络服务提供商侵权行为的归责原则,不同侵权行为所承担的法律责任以及豁免展开论述。
The ever-changing development of network technology brings about a legal revolution in the regulation of the network environment. The network service providers may infringe on the direct infringement and indirect infringement to the detriment of the obligee’s interests, and provide for a reasonable regulation of the network service provider’s legal liability and limitation of liability system. The interests of the parties have an important role. This article will be network service provider tort liability attribution principles, different liability violations and exemptions to start the discussion.
