纵观我国当前反腐形势,党中央坚持高压态势,腐败问题作为治国的重大历史问题,必然向更高、更深的层次发展。但是在研究反腐政策和指导实际办案的过程中,对于法律的适用和惩罚的方式方法等问题亟需进一步厘清,例如行贿人的立功问题,如何认定行贿人在主动交代中的自首和立功等,只有全面解决这些问题,检察机关才能够更加有效的突破行贿人,从而牵出受贿人,才能更有利于检察机关打击腐败,真正让腐败无所遁形。
