由于规模经济理论和成本弱增理论,航空运输业长期被视为自然垄断行业,被排除反垄断法审查之外.但是,笔者认为垄断行业和垄断业务是完全不同的概念,航空运输业中的一些业务是存在充分竞争的,应该纳入反垄断法审查之中.垄断协议行为是最常见的垄断行为,在航空运输业中也毫不例外,在判断航空运输企业中垄断协议时正确适用“合理原则”和“本身违法原则”,两者有不同的价值取向,并非非此即彼的关系,要协调并用.
