少数民族谚语是蕴含着民族认知经验的知识表达方式,其从谚语到“法谚”的语言性质转变源自少数民族对民间法律生活、民族道德经验的总结与传授需要。通过对少数民族谚语与法律关联性的论述,对法谚的“民族—社会”法文化系统进行剖析,指出其充当少数民族社会天然协调剂的潜在功能,旨在从中提取少数民族民间法文化对当代法治建设的启迪,即法律必须依靠世俗化手段才能产生社会同构能力,揭示了少数民族法治生活化背后的民族性依托。
Minority proverbs contain the knowledge expression of national cognitive experience. The change of linguistic nature from proverbs to “proverbs” stems from the summary and teaching needs of ethnic minorities toward the legal life of the people and the ethnic ethic. Through the discussion of the relationship between minority proverbs and law, this paper analyzes the legal system of “ethno-social” law in legal proverbs and points out that it serves as a potential function of natural coordinator of ethnic minority societies in order to extract the folk law of ethnic minorities The enlightenment of culture to the construction of the current law by law means that the law must rely on the secularization measures to produce the social isomorphic ability and reveal the ethnic reliance behind the minority rule of law.
