本文通过对三个不同社区的调查,从权利保护的角度对农村女童受教育权的实现状况进行了研究。作者认为,改革以来,农村女童受教育权的保障机制开始由伦理型向法制型转变,功能得到强化;但农村女童受教育权受损的现象仍不容忽视。文章对农村女童受教育权实现的制约因素、贫困对农村女童受教育权受损的作用方式以及不同社区农村女童受教育权受损的各不相同的类型、人群分布、受损原因进行了具体分析。最后,根据调查结果,作者对加强农村女童受教育权的保护提出了建议。
Through the investigation of three different communities, this paper studies the realization of rural girls’ right to education from the perspective of rights protection. The author believes that since the reform, the guarantee mechanism for rural girl children’s right to education has started to change from ethical to legal system, and its functions have been strengthened. However, the rights of girls in rural areas to education have not been ignored. The paper makes detailed discussion on the restrictive factors of rural girls’ right to education, the mode of effect of poverty on the right of rural girls’ right to education, and the different types, population distribution and damage of rural girls’ right to education in different communities analysis. Finally, based on the findings, the author made recommendations to strengthen the protection of rural girls’ right to education.
