要旨:所谓商标的使用,应当是真实地在商业流通过程中对商标的使用。2001年《商标法》第四十四条第(四)项的规定旨在促使商标真实的投入商业使用,发挥商标应有的区分商品来源的功能与作用,实现商标的市场价值,并非以撤销商标为目的。而商标区分商品来源的功能意味着消费者应可以通过商标将商品与商标权人或商标权人授权许可的使用主体产生对应关联,如果商标与商品来源相分离,则不应认定为商标起到了区分商品来源的功能。
Purport: The so-called use of trademarks, should be true in the commercial circulation of the use of trademarks. The provisions of Article 44 (4) of the Trademark Law of 2001 are intended to promote the real use of trademarks for commercial purposes, give full play to the function and role of trademarks in distinguishing the sources of commodities and realize the market value of trademarks, not to set aside Trademark for the purpose.
