近年随着社会发展,“食物银行”制度在我国逐渐发展,社会各界自愿捐赠食物,经由食物银行联系和处理,提供给有需要的人士,提高了资源分配效率。但以法律视角观之,目前我国“食物银行”的发展存在诸多风险,需明确食品捐赠行为的法律适用以及食品捐赠中各主体的法律责任划分,以期扫清“食物银行”发展的制度障碍和法律风险。
In recent years, with the social development, the system of “food bank” has been gradually developed in our country. All sectors of society voluntarily donated food, contacted and dealt with by food banks and provided them to those in need, thereby enhancing the efficiency of resource allocation. However, from the perspective of law, there are many risks in the development of China’s “Food Bank” at present. It is necessary to clarify the legal application of food donations and the division of legal responsibilities among various subjects in food donations so as to clear the development of “Food Bank” Institutional obstacles and legal risks.
