第三方评估立法是发达国家通行的做法,十八届四中全会提出建立我国的第三方评估立法机制。这一提法在理论研究和工作实践中应确定范围和性质:行政立法评估、行政立法前评估、第三方独立评估和重要立法事项的评估。通过对国内该机制的实践情况、成效和存在问题的研究,提出了拓展第三方评估主体类型,培育第三方评估市场;明确第三方评估机构的条件;建立第三方评估的标准和方法;加强对第三方评估结果的验收与成果的运用等完善建议。
Third-party assessment legislation is a common practice in developed countries. The Fourth Plenary Session of the 18th CPC Central Committee proposed to establish a third-party assessment legislative mechanism in our country. This formulation should determine the scope and nature of theoretical research and work practices: administrative legislative assessment, pre-legislative assessment, independent third-party assessment and evaluation of important legislative issues. Through the research on the practice, effectiveness and existing problems of this mechanism in our country, this paper proposes to expand the types of third-party evaluation subjects, cultivate third-party evaluation market, clarify the conditions of third-party evaluation institutions, establish standards and methods for third-party evaluation, Acceptance of third-party assessment results and the use of results such as sound recommendations.
