信托作为源自英美普通法的财产转移与财产管理的法律制度。经由海牙国际私法会议制定的《关于信托的法律适用及其承认》对国际信托法律制度的统一和发展起了重要的推动作用。本文为详细介绍了海牙公约的立法背景、立法特点和主要结构,拟在此基础上对我国信托法的完善能有所研究和指示。 Trust as a legal system of property transfer and property management derived from the common law of the United Kingdom and the United States. The application of the law on trust and its recognition formulated by the Hague Conference on Private International Law has played an important role in promoting the unification and development of the legal system of international trusts. This article introduces the legislative background, legislative features and main structure of the Hague Convention in details. Based on this, it is hoped that some researches and directives can be made on the improvement of China’s trust law.
